Online Report Delivery Service Agreement
Upon acknowledgement and acceptance of these terms and conditions by Client, whether by electronic means or otherwise in writing, US BioTek Laboratories, LLC. grants Client web-based access to Online Report Delivery which allows Client to access, view and print Client's patient laboratory test results. This service is free of charge to clients.
Terms and Conditions for Use
1. Service
· This agreement begins upon delivery of a combination of a Username and Password to Client.
· This agreement remains in effect as long as Client holds an active account with us and is authorized to order clinical laboratory testing.
· Client agrees to notify us immediately if Client elects to discontinue using Online Report Delivery so that we can provide laboratory results to Client via other means. We will continue to provide patient reports through standard communication means to Client directly, unless requested otherwise by Client.
2. Online Report Delivery Access
· Online Report Delivery access is limited to the ordering health care practitioner for test results of his/her own patients.
· Client is responsible to regularly access Online Report Delivery to retrieve patient test results.
· Electronic data retention period is 60 days from test completion date.
3. Error Reporting/Data Correction
· Client is responsible to report to us the discovery of any virus or other system corruption. We are not liable to Client under any circumstance, for any damages whatsoever, including damages for loss of use or data related to Client's use of Online Report Delivery.
4. Confidentiality
· Client accepts sole responsibility to maintain password security, e-mail addresses, and related updates for client's staffing as needed.
· Client agrees to comply with security and privacy regulations to which Client is subject under state and federal laws, rules and regulations governing the security and confidentiality of laboratory tests and/or result reporting ("Patient Data").
5. Security
· Patient Data is confidential information and constitutes Protected Health Information under the Health Insurance Portability and Accountability Act (HIPAA). As Covered Entities, the HIPAA privacy rule allows providers to share protected health information (PHI) under reasonable and appropriate administrative safeguards. We are deeply committed to safeguarding patient information under HIPAA and in compliance to state and federal law. No electronic system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. No system can adequately address all aspects of the security of electronic health information during the exchange of that information between Covered Entities. By using Online Report Delivery, Client assumes the sole risk of any unauthorized disclosure, intentional intrusion, delay, failure, interruption or corruption of data or other information transmitted in connection with the use of Online Report Delivery service.
6. Disclaimer
· We may alter the functionality of Online Report Delivery at any time without prior notice.
7. Proprietary Information
· Online Report Delivery embodies proprietary information, copyrights and trademarks all of which are and remain the exclusive property of US BioTek Laboratories, LLC.
